Introduction

This Privacy Policy explains how Hello Prolog Inc. (DBA Prolog) (“Prolog” or “we”) collects, uses, and otherwise processes information, including personal data, about visitors to and users of our website, web applications, and other products (the “Services”). This Policy is incorporated into our Terms and Conditions, found here (the “Terms”), which governs your use of the Services.

What Information We Collect

As used in this Policy, “personal information” refers to information that can be used to identify you as an individual or your household.

Information You Provide to Us.

- Account and Profile Information: If you create an account and profile with us, we will collect the information you give us, including your name, company, job title, email address, and phone number. We will also collect and store your account preferences when you interact with our settings menu.
- User Generated Content: You and your collaborators may create and upload content such as project details, candidate evaluations, writing samples, notes, ratings, and other content. This content will be visible only by you and those collaborators you share access with in your project space. You may also create custom tags to help organize candidates. Please note that candidate bios and tags may include demographic information about that individual, but Prolog does not process such data separately from any other text.
- Payment Information: We offer payment processing though our third-party provider, Stripe. Prolog does not collect, store, or otherwise process payment card or banking information, except to the extent necessary to maintain a payment preference in your account.

Information We Collect Automatically

When you access or use our Services, we may automatically collect information about your or your device, including:
- Log and usage data: This includes your IP address, user ID, browser type, operating system, referral URLs, device information, and device settings.
- Actions when using the Services: We collect information about the actions you take when interacting with the Services. This includes your interactions with pages, links, and content, like searching, tagging, rating, and similar actions. It also includes your interactions with other users (when done through the Services).
- Location information: We do not track your location, although your IP address gives us a general idea of your city and state. We only collect an address if incorporated into user generated content you upload.
- Information collected from cookies and similar technologies: We may receive information from cookies, which are pieces of data your browser stores and sends back to us when making requests, and similar technologies. We use this information to improve your experience, remember your settings and preferences, understand user activity, personalize content and advertisements, and improve the quality of our Services. For example, we store and retrieve information about your preferred language and other settings. Information We Receive from Other Sources

We may process information about you from sources like your authorized agents and managers. Personal information submitted on behalf of another party must be done with the party’s approval and consent. If your information was submitted to us, and you would like it removed, please contact us (see the Your Choices section below).  

How We Use Your Information

We use the information we collect from you and about you for the primary business purpose of providing a platform for entertainers and their clients to connect. This involves:
  • Providing, maintaining, and improving the Services;
  • Personalizing the Services, content, and features to reflect user preferences.
  • Helping protect the safety of Prolog and our users, addressing abuse, and enforcing the Terms and other policies;
  • Sending you account notices, notifications, updates, and other administrative messages;
  • Providing customer service;
  • With your consent, sending you marketing e-mails about our products and services, upcoming promotions, information about our partners and affiliates, and other news. You may opt out of receiving such information at any time, and such marketing emails tell you how to do so. Please note, even if you opt out of receiving marketing emails, we may still send you non-marketing emails (for example, emails about your Account or our business dealings with you);
  • Facilitating payments you make via the Services (which are processed using a third party provider);
  • Monitoring and analyzing trends, usage, and activities in connection with our Services.

How We Share Your Information

We do not sell your personal information. In addition, we only share personal information in the following ways:
  1. with your express consent;
  2. in an aggregate or anonymized format that does not identify you;
  3. as required by law, or to comply or respond to a valid government request;
  4. when we believe in good faith that it’s necessary to protect our rights, protect your safety or the safety of others, or investigate fraud;
  5. with a buyer or successor if Prolog is involved in a merger, acquisition, or similar corporate transaction. If that happens, you will be notified via email and/or a prominent notice on the Website of any change in ownership, as well as any choices you will have as a result;
  6. With our service providers (businesses that work for and with us) for the purpose of running the Services and fulfilling our commitments to you. These include businesses that perform services on our behalf, including to help us host and maintain our products, to provide support for legal, banking, security protection, payment processing, our own marketing, and customer service. Please know that when we share information with our service providers, it's for the purposes outlined in this Privacy Policy and not for their independent use.

How We Protect Your Information

We use reasonable organizational, technical and administrative measures to protect personal data within our organization. Unfortunately, transmission of information via the internet is not completely secure, nor can we guarantee the security of any transmission or storage system. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us as set forth below.

We store the information we collect for as long as it is necessary for the purpose(s) for which we originally collected it. We may retain certain information for legitimate business purposes or as required by law.  

Links or Content from Other Websites

Third Party Links

Our Services may contain links to other sites that we do not own or operate. We do not control these sites and are not responsible their content, products, services, or privacy policies or practices. We recommend that you review these other sites’ privacy policies and made your own determination as to your use of them.

Embedded Content

We may display some linked content in-line on our Services via “embeds,” such as Youtube videos, so you don’t have to leave Prolog to see it. We do not control how third-party services collect data when they serve you their content directly via these embeds. As a result, embedded content is not covered by this privacy policy but by the policies of the service from which the content is embedded.

Your Choices

We may communicate with you through several different channels, including email, email notifications, or customer support chat. You can control which method we use to communicate in the preferences section of your profile.  

You may opt out of receiving some or all categories of marketing communications from us by following the instructions in those communications (for example, by clicking the unsubscribe link) or in the preferences section of your profile. If you opt out of marketing communications, we may still send you non-promotional communications, such as information about your account or your use of the Services.

Deleting Your Account
If you wish to delete your account, you can submit a request to delete the personal information Prolog maintains about you by contacting us at team@helloprolog.com. When you delete your account, your profile is no longer visible to other users. Please note, however, that the notes and other project materials you submitted prior to deleting your account may still be visible to your collaborators, unless you first delete the specific content. We may also retain certain information about you as required by law or for legitimate business purposes after you delete your account.        

Additional rights regarding your data

If you live in California, Colorado, or another state with heightened data privacy rights, you have some additional rights when it comes to your data.
  1. Right to Delete: You can ask us to delete the personal information we have about you.
  2. Right to Know: You can ask us for a list of the categories of personal information we have about you, the categories of sources from which we get personal information, the business purposes for which we collect personal information, and the categories of third parties with whom it is shared (you can also see that in this Privacy Policy).
  3. Right to Access: You also can ask us for a copy of the pieces of personal information we have about you.
To exercise any of these rights, you (or your authorized agent) can contact us by email at team@helloprolog.com. We will confirm receipt of your request within 10 days, and will provide a response to you within 45 days of your request, though in some exceptional cases it might take longer (if that happens, we'll let you know). We will need your name and email address to verify your request, and may also ask for additional information if necessary to verify the identity of the person making the request. We reserve the right to deny your request if we cannot verify your identity, or if an exemption applies (for example, where fulfilling your request would adversely affect other individuals, or where we have a conflicting legal obligation). That said, we will not discriminate against you for exercising any of your privacy rights.

To learn about the categories of personal information that Prolog processes, please see the sections of this Privacy Statement called “What Information We Collect.” The personal information that we have collected in the past 12 months falls into the following categories as set out under California law:   
  1. Identifiers: name, email address, IP address
  2. Professional or employment-related information
  3. Commercial Information
  4. Characteristics Of Protected Classifications (if submitted with a writer bio)
  5. Internet Activity (your interactions with the Services, including content you post on our platform and the content of communications sent to or through us)
  6. Geolocation (your approximate city/state from your IP address)
We do not sell your data. To learn about the limited ways in which we disclose data for our business purposes -- that is, to a service provider -- and the categories of those service providers, please see the section of this Privacy Policy called "How We Share Your Information."

Please note that, while Prolog provides tools to manage your privacy as described in this Privacy Policy, we do not support “Do Not Track” browser settings at this time.

California residents also have the right to request this information in an accessible alternative format. If you have a disability and would like to access this Privacy Policy in an alternative format, please contact us by email or mail as detailed below.

Additional rights regarding your data

If you are an individual in the EEA, and happen to access the Services, note that Prolog is acting in the capacity of Controller when collecting and processing personal data on our own behalf and for our own purposes. The personal information that you share and we collect, as well as its purposes, are described in this Privacy Policy. We will only collect or process your personal information if we have a legal basis to do so. These are:
  1. as necessary to fulfill our Terms and provide the Services;
  2. consistent with your consent, which you may revoke at any time;
  3. as necessary to comply with our legal obligations;
  4. occasionally to protect your vital interests or those of others;
  5. as necessary in the public interest; and
  6. as necessary for our (or others’) legitimate interests, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.

We may rely on different lawful bases for collecting and processing personal data about you, for example, with your consent and/or as necessary to provide the products you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our users, or fulfill other legitimate interests.
International Data Transfers: As we are located in the United States, if you are located outside of the United States, please be aware that information you share and we collect may be transferred to, and processed, stored, and used in the United States in order to provide the Services to you.

Individuals Under 13

The Services are not directed to individuals under the age of 13. We do not knowingly collect, use, or disclose personal information from anyone under 13 years of age. If we become aware that we have unknowingly collected personal information from an individual under 13, we will make reasonable efforts to delete such information from our records.

Type of Cookie: Functionality Cookies
Purpose: These cookies allow the Platform to remember choices you make when you use our Site and Platform, such as remembering your language preferences, remembering your login details and remembering open projects. The purpose of these cookies is to provide you with a more personal experience and to avoid you having to re-enter your preferences every time you use the Platform.

Type of Cookie: Analytics and Performance Cookies
Purpose: These cookies are used to collect information about traffic to our Platform and how users use our Site and Platform. The information gathered does not identify any individual visitor. The information is aggregated and anonymous. It includes the number of visitors to the Platform, the websites that referred them, the pages they visited on the Platform, what time of day they used the Platform, whether they have visited our Site or used the Platform before, and other similar information.  We use this information to help operate the Platform more efficiently, to gather broad demographic information and to monitor the level of activity on the Platform.

Type of Cookie: Social Media Cookies
Purpose: These cookies are used when you share information using a social media sharing button or “like” button on the Platform or you link your account or engage with our content on or through a social networking website such as Facebook. The social network will record that you have done this. We also use cookies and similar technologies to personalize and measure the effectiveness of our own advertising on third-party platforms.
